The Conservative Court Turns Left

The same court that brought us corporations as people, unlimited political money, abortion restrictions, a step backwards in voting rights, and unequal pay has now thrown some serious bones to the left in the form of a stronger Affordable Care Act and a right to gay marriage. I’m sure that wherever they are, David Souter and Sandra Day O’Connor are smiling just as broadly as President Obama and millions of formerly marginalized United States citizens are across this land.

It just goes to show you that handicapping Supreme Court decisions based on the justices’ questions and demeanor during oral arguments is a dangerous, unpredictable sport. Remember that the Chief Justice asked only one substantial question during the health care arguments, but he surprised almost everyone by writing a rather forceful decision upholding the law. Justice Kennedy was widely seen as the bellwether on marriage equality, and he provided the fifth vote to recognize that dignity comes in many forms.

The Originalist Triplets from Different Mothers–Scalia, Thomas and Alito–certainly didn’t disappoint their right wing adherents by pointing out to us that laws should be read as written and that if marriage was a right, then why didn’t the nation recognize it until now? Never mind that the country didn’t recognize civil rights for African-Americans for over 100 years after the Civil War, and that was with an amendment specifically crafted to remedy that injustice. Justice Thomas’s career-defining quote about how slaves did not lose their dignity because the government allowed them to be enslaved was not only a jaw-dropping bit of incongruity, but also a shocking misunderstanding of what the word means.

But this is the danger of the originalist doctrine. It presumes to know exactly what the Framers meant not only in their time, but in ours. I’m no legal expert, but I’ve committed my professional life to teaching history and my reading is that those men who gathered in Philadelphia were a bit more flexible on legal interpretations than the originalists give them credit for.

Rather than be shocked at what American society has become, I think they would be pleased, perhaps even giddy, at the idea that we’ve become as multicultural, open, democratic and accepting as we are now. I would be disappointed if Madison, Washington, Hamilton or any of the others came to our century and said that we had completely misread the meaning of their words. After all, they included both the elastic clause and the ability to amend the constitution.

Meanwhile, Scalia, Thomas and Alito (and sometimes Roberts) would roll back civil rights laws and would have us believe that the Fourteenth Amendment, the one that guarantees every citizen equal protection of the law, has nothing to say about guaranteeing LGBT Americans, well, the equal protection of the law. or that four words in the health care law were meant as grenades that would blow it up rather than mechanisms to guarantee that less-well-off Americans could get affordable health care. Scalia especially seems to believe that the only rights that Americans have are the ones granted in 1787. How thoroughly regressive.

It’s worth noting that another group, Confederates, also believed they knew the true meaning of the Republic. They wanted to live in a country that allowed states to decide almost all aspects of public policy, protect slavery and Jim Crow, and to nullify federal laws they didn’t agree with. That’s why they broke away and were almost successful in creating such a country. Their loss still resonates in the south and it’s time to bring that era to a close. We shouldn’t destroy every vestige of it, but it’s past time to take down the flags and statues (and put them in museums where they belong), and to rename some streets. We’ll be a better country for it.

What history will more likely remember is the rock-solid support for humanity and progress that the four liberals–Sotomayor, Breyer, Kagan and Ruth Bader Ginsburg–continue to fight for. Their opinions were subsumed under Kennedy and Roberts, but they should rightly be proud, and thanked, for their steadfast support for the citizens of this country.

As we move forward from last week, we need to remember that many states will be required to recognize marriages, but off the alter those states can continue to discriminate based on sexual orientation and use religious belief as a hammer against full equality. I certainly support religious values, but it’s time to recognize that Biblical prohibitions that discriminate, marginalize and promote hate are…wrong.

Bu that’s a discussion for the future. Right now I’m going to buy some rainbow sherbet, kick back, and celebrate America.

Mike Huckabee Threatens to Leave The Republican Party – Audio

Since the United States Supreme Court decided not to take up same sex marriage, over 30 more states have adopted the lower courts’ decision and allowed gay couples to marry their partners. This is not going over well with some Republicans and some, like former Republican Presidential candidate Mike Huckabee, is demanding that the party stand up and defend its values.

Huckabee warns that if the Republicans fail to lead, he and more like him, will leave the party and become members of the independent.

On Wednesday’s broadcast of American Family Association’s Today’s Issues program, Huckabee lambasted the Republican party and it’s leaders for allowing gays to marry and giving up on their so-called “moral” obligation in being the obvious superior party.

*Eyeroll*

“I am utterly exasperated with Republicans and the so-called leadership of the Republicans who have abdicated on this issue,” warning that by doing so the GOP will “guarantee they’re going to lose every election in the future.”

“Guarantee it,” he said before proclaiming that the Republicans are going to “lose guys like me and a whole bunch of still God-fearing, Bible-believing people” if the party does not stand and fight on the issues of gay marriage and abortion.

“I’m gone,” Huckabee warned. “I’ll become an independent. I’ll start finding people that have guts to stand. I’m tired of this”:

Hillary Clinton Gets Testy In NPR Interview on Gay Marriage

Just lay off the lady already. NPR got the chance to interview the potential 2016 candidate, Hillary Clinton, and things kinda got out of hand. The NPR interviewer pushed and pushed Mrs Clinton to the point where the former Secretary of State had to put her foot down and explain that if her position changed on gay marriage, it wasn’t done for political reasons like was being implied.

“I have to say, I think you are being very persistent, but you are playing with my words and playing with what is such an important issue,” Clinton said.

“I’m just trying to clarify so I can understand …” Gross said.

“No, I don’t think you are trying to clarify,” Clinton snapped back. “I think you’re trying to say I used to be opposed and now I’m in favor and I did it for political reasons, and that’s just flat wrong. So let me just state what I feel like you are implying and repudiate it. I have a strong record, I have a great commitment to this issue, and I am proud of what I’ve done and the progress we’re making.”

The exchange comes the same week that Clinton began her book tour and accompanying media rollout, during which there has already been at least one other rocky moment: When she said that after leaving the White House, she and former President Bill Clinton were “dead broke,” a remark she has since sought to clarify.

A recording of the NPR interview was shared with POLITICO by America Rising, a Republican research group that’s spent the majority of its time focused on Clinton. “Fresh Air” is a favorite program among progressives.

“I did not grow up even imagining gay marriage, and I don’t think you probably did, either,” Clinton said to Gross. “This was an incredibly new and important idea that people on the front lines of the gay rights movement began to talk about and slowly, but surely, convinced others of the rightness of that position. And when I was ready to say what I said, I said it.”

Clinton was lauded at the State Department for focusing on LGBT issues related to agency personnel and also in other countries. But she formally stated her support for gay marriage only after a number of prominent Democrats, such as New York Gov. Andrew Cuomo and Maryland Gov. Martin O’Malley, and even some Republicans, such as Ohio Sen. Rob Portman, had already done so.

Her allies have attributed her timing to the need for her to stay apolitical while at the State Department.

“You know, somebody is always first, Terry,” Clinton said. “Somebody is always out front, and thank goodness they are. But that doesn’t mean that those who join later, in being publicly supportive or even privately accepting that there needs to be change, are any less committed. You could not be having the sweep of marriage equality across our country if nobody changed their mind, and thank goodness so many of us have.”

Mass gay Marriage at Grammys Enraged Conservatives – Mass Shootings, Not So Much

The Grammys last night broke a rule. No, not the joining of rapper Kendrick Lamar and Imagine Dragons as they did something never done before – perform a rap song in the form of heavy metal, or is it performing heavy metal in the form of a rap song. Whatever it was, it was amazing, and it was a first according to host LL Cool J.

Wow. That was freaking amazing!

But so was the second rule that the Grammys broke last night, and the ourtrage today by the conservatives shows just how big a deal this rule was. Apparently, there was a rule that said never marry gays at the Grammys. That rule is no more as Queen Latifah presided over the joining together of 34 couples. And conservatives are flipping out!

The headline at The Drudge Report this morning spoke of “THE GAYMMYS,” and Twitter was overrun with people discussing the ceremony officiated by Queen Latifah during Macklemore’s performance of the same-sex marriage anthem “Same Love.”

At the conservative site Free Republic, a commenter who confessed to “see[ing] gays at the store” complained about how “[t]hey take every venue, every event, and have to gay it.” Another prayed that “the hands of the demented who applauded this sickeness rot off at their limp wrists.”

Those on the left generally applauded the ceremony. Hemant Mehta, the Friendly Atheist, tweeted:

Meanwhile, thousands die yearly at the hands of someone weilding a gun. Yet these same conservatives fight tooth and nail to deny sensible regulations, thus, keeping the death rate as high as possible.

Only in America.

This Republican Official Wants to Abolish All Marriages To Stop Gays from Marrying

A Republican lawmaker in Oklahoma has proposed a controversial way to stopping same-sex marriages in the state. According to News9.com, state Rep. Mike Turner (R) has proposed scrapping marriage in the state altogether.

The lawmaker contends that it is the only way to keep same-sex marriage illegal in the state while still defending the U.S. Constitution.

“[My constituents are] willing to have that discussion about whether marriage needs to be regulated by the state at all,” Turner told Channel 9.

Other lawmakers feel the same way, he said. They envision a state that doesn’t recognize any marriages at all.

“That would definitely be a realistic opportunity, and it’s something that would be part of the discussion,” Turner said.

The Republicans currently have what is called a shell bill in the roster of bills on the state house floor. They can call the bill to the floor for debate or rewrite it at a moment’s notice in order to respond to any rulings regarding the state’s ban on same-sex marriage.

Republican Mark Kirk Joins Rob Portman In Supporting Same Sex Marriage

Another Republican congressman comes out in support of gay marriage, and this time, it didn’t take his son being gay for him to accept gays loving each other. He now joins Rob Portman as the only two Republicans in Congress approving of same-sex marriage.

Sen. Mark Kirk of Illinois announced his support Tuesday for gay marriage, becoming the second Republican to endorse marriage equality.

Kirk, who recently returned to Congress after suffering a stroke, joins Sen. Rob Portman of Ohio as the only sitting Republican senators to support marriage for same-sex couples.

“Same-sex couples should have the right to civil marriage,” Kirk said in a statement. “Our time on this earth is limited, I know that better than most. Life comes down to who you and love and who loves you back — government has no place in the middle.”

The senator’s announcement comes a week after the U.S. Supreme Court heard historic arguments challenging same-sex marriage and as public opinion polls show more acceptance. The change in attitudes has also been occurring in the U.S. Senate, starting first with Portman and then a host of Democrats who have publicly declared their support.

Rob Portman Endorses Gay Marriage After Being Personally Affected By The Issue

We’ve seen this story played out many times in the past. If a Republican is not directly affected by something, then they are going to be against it. That was Ohio’s Senator Rob Portman’s position on gay marriage until the gayness came knocking on his door.

Portman’s change of heart came in February 2011 when he found out that his own 21 year old son was gay. “That isn’t how I’ve always felt,” Portman said, acknowledging that he was once against the very idea that two people in love should get married. He revealed to CNN. ““I’ve come to the conclusion that for me, personally, I think this is something that we should allow people to do, to get married, and to have the joy and stability of marriage that I’ve had for over 26 years. That I want all of my children to have, including our son, who is gay.”

And in an op-ed in the Columbus Dispatch, Portman wrote, “I have come to believe that if two people are prepared to make a lifetime commitment to love and care for each other in good times and in bad, the government shouldn’t deny them the opportunity to get married. As a Congressman, and more recently as a Senator, I opposed marriage for same-sex couples. Then something happened that led me to think through my position in a much deeper way.”

So why is Portman coming out now in support of gay marriage? He is directly affected. Portman explains;

“Now it’s different, you know. I hadn’t expected to be in this position. But I do think, you know, having spent a lot of time thinking about it and working through this issue personally that, you know, this is where I am, for reasons that are consistent with my political philosophy, including family values, including being a conservative who believes the family is a building block of society, so I’m comfortable there now.”

John Fugelsang said it best today on the Stephanie Miller Show, when he said that we can’t wait for Portman’s son to come out as the middle class. Maybe then, Portman will be inclined to do more for the jobless and suffering in this country.

Portman was on the short list to be Mitt Romney’s vice presidential candidate. He admitted to telling Romney that he had a gay son. Romney eventually chose Paul Ryan as his VP.

Pastor Frederick Haynes Supports President Obama’s “Personal Opinion” On Gay Marriage

With all the publicity given to some pastors who jumped in front the television cameras to voice their opinion on President Obama’s support for gay marriage, there is another pastor who is taking the President’s side. Needless to say, he is not on any popular talk show voicing his comments on the matter, but in the video below, he is seen preaching a very moving sermon explaining to his congregation that President Obama is not “Pastor of the United States, he is President of the United States.” And as President, Mr. Obama’s job is to uphold the Constitution and the rights that the Constitution provides to all Americans.

His name is Senior Pastor Frederick Haynes III, and part of his sermon is below.

Republicans Against Republicans In New York

There’s some wild political in-fighting going on in New York, and no, we’re not talking about the Anthony Weiner saga. This time it’s Republicans against Republicans and the fight’s about legalizing gay marriage, which Andrew Cuomo, the Democratic governor of the state, is doing all he can to push to legalize.

“This state has a proud tradition and a proud legacy as the progressive capital of the nation,” he said Friday. “We led the way, and it’s time for New York to lead the way once again.”

However, not all the legislatures see things Cuomo’s way. The state’s Republican politicians have been the main stumbling block and they’ve been on a mission to see that the Democratic efforts to legalize gay marriage fails. But there are cracks showing up in the united Republican’s stonewall against it, and one Senator has jumped ship and is calling his party out. His name is Roy McDonald, a 64-year-old Senator and this is what he said;

“You get to the point where you evolve in your life where everything isn’t black and white, good and bad, and you try to do the right thing. You might not like that. You might be very cynical about that. Well, fuck it, I don’t care what you think. I’m trying to do the right thing. “I’m tired of Republican-Democrat politics. They can take the job and shove it. I come from a blue-collar background. I’m trying to do the right thing, and that’s where I’m going with this.”

Of course, Republicans will now go out of their way to make sure Roy looses his seat next election, but like Roy said, he’s “trying to do the right thing.” Good to know there’s still some Republicans who will put party politics aside, and do what’s right.
