The Abortion Freeport Doctrine

In 1857, the US Supreme Court ruled in Dred Scott v. Sandford that slavery was legal and that slaves were property. Illinois Senator Stephen Douglas, in debates with challenger Abraham Lincoln in 1858, was a supporter of popular sovereignty on slavery, That is, he wanted to let the people of a territory decide if it was to be legally free or slave. This, obviously, wouldn’t be possible given the Court’s decision because the justices said that slavery could not be banned. So Douglas came up with a dance that came to be called The Freeport Doctrine. This doctrine would allow slavery, but would encourage territories to enact high legal boundaries to its implementation, rendering it moot in practice.

Despite the Supreme Court’s decision in Roe v. Wade in 1973, anti-abortion groups have stopped at nothing–not even the law–to enact high legal hurdles that inhibit the right of every women to control their reproductive lives and health choices. In one of the presidential debates in 2004, George W. Bush even invoked Dred Scott as a guiding principle for his judicial choices. Abortion equals slavery. Welcome to the Abortion Freeport Doctrine.

Three states have taken this tactic to new extremes. Texas passed an onerous law that will result in the closing of more than half of the remaining clinics in the state. Arizona passed a law, now under judicial review, that would restrict medication abortions. And Mississippi Governor Phil Bryant said today that he will sign a law that will prohibit abortions after 20 weeks of pregnancy, and with no exception for rape or incest This is all on top of restrictive laws that have been passed, and have passed judicial muster, over the 41 years that Roe has been the law of the land. The Supreme Court is now weighing whether the Affordable Care Act can require all employers to cover contraception for all of its employees, because those companies consider some contraception to mimic abortions.

This is an emotional issue and the debate over abortion does not yield any middle ground. But we can find a way to make abortions less likely, provide contraception and sex education, and allow women and their doctors to make decisions that are in the best interests of the patient. That’s called freedom of choice and it’s something I hear a great deal about from those on the political right who want the government out of our lives, except in the bedroom. Or kitchen. Or back seat. Or…you get the point.

My solace comes from the belief that the conservative tide has crested and that we’re seeing the worst of the restrictions now. Many will stay in the most conservative states, but the idea that a women’s body is her own is pretty much a settled social idea that the court overturns at the country’s peril. It’s worth remembering that the Freeport Doctrine went nowhere. It’s also worth remembering that it took another hundred years for African-Americans to gain their full legal rights. I hope we’re not still debating the choice issue 60 years from now.

The US Navy is Gearing Up in The Ukraine

With Russian forces already in the area, the US Navy is now getting involved.

The U.S. Navy is sending a destroyer into the Black Sea in the coming days as a symbolic gesture of support for Ukraine and other allies in the region, according to two senior defense officials.

The USS Donald Cook, a guided missile destroyer based in Rota, Spain, and will travel to the Black Sea “in the next week or so,” according to one senior defense official.

The ship will take part in to-be-scheduled exercises with allies in the region — most likely pass exercises, where ships from different nations pass one another while at sea — and the Donald Cook will make several to-be-scheduled port calls.

New York UPS Fires 250 Workers Because They Held a 90 Minutes Protest

UPS has delivered a special message to 250 of its Queens drivers: You’re fired!

The Atlanta-based company is booting 250 of its unionized drivers from its Maspeth facility because they walked off the job for 90 minutes Feb. 26 to protest the dismissal of a long-time employee, UPS told the Daily News.

Twenty employees were terminated Monday after their shifts — and the remaining 230 notified that they’ll be canned as soon as replacements are trained, a company spokesman said.

“They just called me in … (and) said, ‘Effective immediately, you are no longer on the payroll,’” said Steve Curcio, 41, a 20-year employee earning $32 an hour.

The mass firing has enraged Tim Sylvester, head of the International Brotherhood of Teamsters Local 804, especially since the company gets some lucrative perks from the city.

United Parcel Service has a contract worth $43 million to provide delivery services to city and state agencies, according to documentation from city officials.

Man Jumps Over White House Fence – Is Immediately Arrested

The Secret Service says a man has been arrested after he climbed over a fence at the White House.

Secret Service spokesman Brian Leary says the man climbed over the fence around 4 p.m. Sunday and was immediately arrested. The White House briefly went into lockdown after the incident, which is standard procedure.

The Secret Service did not immediately release the identity of the man, and Leary said charges were pending.

Obama returned to Washington on Saturday after a weeklong trip abroad.

Bystanders who were at the scene took to social media to describe the incident.

‘Just saw a guy jump the white house fence and get attacked…’ one wrote.

‘I just watched a guy jump the fence on to the presidents lawn. That’s right the White House!! #DCtrip #Tripmade,’ another wrote.

March 31 Is Only The Beginning

I suppose it would have been fitting if the Obama Administration had scheduled April Fool’s Day as the last day to sign up for health insurance under the Affordable Care Act. We’ve certainly been treated to a smorgasbord of ineptitude, shifting deadlines, executive pronouncements that let certain economic sectors off the hook, and some rude, disrespectful, sometimes hateful objections from the right-wing about the entire business.

That’s why March 31 is so important. It represents the end of the first, and possibly most vital, stage of the implementation of the act. Millions of people have signed up for heath insurance. Millions of others are now covered by Medicaid. The federal and state websites are still balky, but they work. The end of the beginning is upon us. It can only get better from here. And the best part is that the law is working.

Republicans have dropped their demand that the law be scrapped, which six months ago looked like a possibility as they shut down the government and Healthcare.gov showed exactly what can go wrong when the government attempts to shortchange the software cycle. Now the arguments are that the law needs to be fixed, although GOP candidates are running against it to the exclusion of everything else, except perhaps voter ID laws that will guarantee a Republican majority in the House for the foreseeable future. Even Democrats in tossup races in Louisiana and North Carolina are talking about fixing the law so it doesn’t ensnare the middle class and endanger employer-provided health insurance.

The problem is that, over time, that’s exactly what the law will accomplish. We are moving into uncharted waters, where the employer mandate will shift and companies will start to drop health insurance from their benefit plans. How this will work is the key. Will companies give employees a voucher with a dollar amount attached to it to buy insurance? Will they raise wages so people can pay for their own policies? Will insurance companies bring down the cost of policies so they can remain viable? Will we eventually get a public option that takes private insurance out of the economy? These are the questions that will define how successfully the ACA reforms the health care industry. Follow the money. That’s always been the gold standard of social change.

My sense is that employer-sponsored health insurance will be gone from most industries within 7-10 years, and the fallout won’t be as bad as some have predicted. Companies have a vital interest in the health of their workers and insurance companies won’t want to price people out of plans. Without the major expense of providing health insurance, companies will be able to pay workers more, though not too much more. The minimum wage will be less of a burden as it rises. Workers will need to make healthier choices and get checked more often before health issues become major concerns. The GOP calls this personal responsibility, and they accuse the Democrats of coddling the country with social programs. The ACA will do more for people taking control of their health than anything we’ve done in the United States. Remembers, the ACA is based on Republican ideas. That’s why the law is both a curse and a blessing.

All of that is in the future. For now, President Obama’s approval numbers are in the tank. History will remember him far more positively.

Nissan Recall – 990,000 Airbags Need Fixing

Nissan is recalling 2013 and 2014 model-year Leaf electric cars to fix an airbag sensor software issue.

The recall will correct faulty software in approximately 29,165 Leafs that controls the front-passenger seat Occupant Classification System (OCS), which senses weight to determine if a person is sitting in the seat.

The OCS is used in the Leaf and most other production cars to prevent airbag deployment when the passenger seat is unoccupied, or when an underweight individual is sitting in it.

In the affected vehicles, the system may read the seat as empty even if it is occupied as an adult. If this happens, the passenger front airbag will be deactivated and will not deploy in a crash.

Nissan dealers will reprogram the OCS software free of charge. This is expected to begin in mid-April, but owners will be notified of the exact date

FBI Fugitive Arrested Days after Being Added to Most Wanted List

An accused gang banger was arrested Friday for the murder of his girlfriend and her toddler son only days after being put on the FBI’s ‘Most Wanted’ list, federal authorities said.

Juan Elias ‘Cruzito’ Garcia, 21, a reputed member of the murderous international gang known as MS-13, was taken into custody after voluntarily returning to the US to face the charges, according to an FBI press release.

Garcia, who has ties to El Salvador, Nicaragua, Honduras, Guatemala and Panama, is accused in the 2010 execution-style shooting of the mother and child in Central Islip, New York, authorities said.

Garcia’s girlfriend Vanessa Argueta, 19, and her son, Diego Torres, 2, were victims in the brutal slaying.

He Friday surrender came just two days after being put on the most wanted list, it was the result of a coordinated effort between Nicaraguan authorities and US law enforcement.

American authorities sent aircraft to bring Garcia to New York.

Garcia was threatened by rival gang members after an argument with Argueta. He accused her of going behind his back to the gang, the FBI said.

Garcia and two fellow gang members shot her and her son dead after luring them to a wooded area in February 2010, said the FBI.

The mother was killed first, causing the young boy to start crying, said investigators, He was then hit by a bullet that knocked him down, the FBI said.

‘Torres got back up and clutched onto Garcia’s leg’ before he was shot in the head, according tot he FBI.

Fellow accused gang members Adalberto Ariel Guzman and Rene Mendez Mejia are awaiting sentencing after Mejia pleaded guilty to the murders and Guzman was found guilty at trial.

Gang leader Heriberto Martinez has been sentenced to three life terms, plus 60 years, in prison for multiple convictions that include murder, racketeering and conspiracy.

Bridget Kelly Responds to “Sexist Remarks” in Christie’s Bridge Gate Report

The lady at the center of the BridgeGate scandal is no longer staying quite. In a statement issued by her lawyers, Bridget Kelly slammed the assertions made by Christie’s lawyers that she closed the lanes on the George Washington Bridge last September because of a failed relationship she had with Bill Stepien.

Having reviewed the report of Gibson, Dunn & Crutcher, LLP, as well as listened to the comments of Randy Mastro, Esq., we note that by Mr. Mastro’s own admission, he did not have access to all information. Of course, without reviewing all pertinent evidence, any conclusions that are to be drawn are by definition incomplete. The report’s venomous, gratuitous, and inappropriate sexist remarks concerning Ms. Kelly have no place in what is alleged to be a professional and independent report.

There appear to be two distinct versions of the George Washington Bridge lane closings. On the one hand, Mr. Wildstein, through his counsel, has taken one clear position. On the other hand, Mr. Mastro has staked a different view. Thus, Ms. Kelly’s evidence could be critical to verifying either of the two competing versions of events. A preemptive strike to isolate Ms. Kelly and impugn her credibility is not surprising. Despite Mr. Mastro’s editorialized comments to the contrary, Ms. Kelly is not a liar. She is a single mother of four children who was deeply devoted and committed to her job at the Office of the Governor. She worked tirelessly to pursue the goals of the Office during her tenure.

The only credible investigation into the lane closings is being conducted by the U.S. Attorney’s Office. If Ms. Kelly were provided with the appropriate procedural safeguards, she will be fully cooperative and provide truthful and complete answers to any questions asked of her by the appropriate law enforcement authorities.

Belgian husband leaves wife of 19 years after discovering she was a man

A Belgian husband has spoken of his ‘horror’ after learning his wife of 19 years used to be a man.

The duped 64-year-old – named only as Jan – said he had ‘no clue’ his bride had been born a boy.

The shocking revelation only emerged after almost two decades of marriage when a cousin from his wife’s native Indonesia finally exposed the truth.

Jan told how he met ‘Monica’ in 1993 when she arrived in his home town of Antwerp as an au-pair to his sister’s children.

‘I thought she was an attractive woman, and she was all woman – she had no male traits.

‘She was 27 years old at the time, so I asked her if she wanted children.

‘I was glad when she said she didn’t as I was 44 and already had two of my own.

‘Over the years she said she was taking the pill, and even during sex I never noticed anything, though now I understand why she always used a lubricant, which is apparently normal among transexuals.

‘She was always a good mother to my children, and also a fantastic cook, though we wasn’t that great at cleaning and ironing – and now I know why!’

But Jan said the relationship had begun to suffer over the past two years as she insisted on staying out late on her own wearing ‘very revealing outfits’

He added: ‘She would wear tiny tops that revealed a lot of flesh and had more than 100 pairs of shoes.

‘I also caught her ogling pictures of young men on the Internet.

‘But I didn’t suspect a thing until a cousin of hers came to visit and let something slip.

‘I mentioned it to my son and he said he’d heard a rumour too that Monica used to be a man.

‘One evening I confronted her and she finally confessed she had been born a boy and had a sex change operation.

‘My world collapsed in a few seconds. I was horrified. I feel like have been violated for almost 20 years.’

The couple are still living under the same roof after a judge refused to grant Jan an order to evict her.

But he added: ‘We live in separate rooms and rarely speak. What Monica has done to me and my family is unforgivable. I just want her out of my life.’

FBI’s 10 most Wanted List – Tiny Thug Who Murdered Girlfriend and 2 Year Old Son

He’s 5 ft 4inches.

A Salvadoran thug who executed his 19-year-old ex-girlfriend and let fellow gang members shoot her terrified two-old-son as he grabbed his leg for help has been added to the FBI’s ‘Ten Most Wanted Fugitives’ list.

MS-13 gang member Juan Elias Garcia, 21, whose last reported sighting was somewhere in Honduras in 2011, is the fourth person sought by federal authorities in the Long Island killings of 19-year-old Vanessa Argueta and her 2-year-old son Diego Torres, said George Venizelos, the FBI assistant director of the New York field office.

Garcia, who is 5 feet 4 inches tall, and weighs 125 pounds is a native of El Salvador and is the first MS-13 gang member to make the bureau’s most wanted list.

He allegedly brought Argueta to the woods of Central Islip, Long Island in February 2010 under the ruse of taking her to to dinner, Venizelos said.

Argueta was accompanied by two other reputed MS-13 members who had received permission from the gang’s leader to carry out the killing, Venizelos said.

One of them shot her in the chest and head because of alleged threats made toward Garcia by rival gang members to whom she had ties, according to Venizelos.

Her son who witnessed his mother’s death began crying the thugs shot him in the head — but the wound proved not fatal and the terrified boy grabbed Garcia’s leg.

Then another gang member, Adalberto Ariel Guzman, shot him in the head a second time, killing the boy.

‘Once on his feet, Diego saw Garcia, a familiar face in the crowd, and clutched onto his leg. However, the violence did not stop. Guzman fired the second shot that struck Diego in the head and killed him,’ Venizelos said.

‘Garcia decided that penalty for disrespecting the gang was death,’ Venizelos said. ‘While crime and gang-related activity often goes hand in hand, the execution-style murders of Vanessa and her 2-year-old son is a new low even for MS-13.’

Garcia, who was only 17 when the crime took place, is alleged to be a member of the violent Mara Salvatrucha gang, known as MS-13, and is believed to be hiding in El Salvador, authorities said Wednesday.

‘MS-13 is the most violent gang here of any of the street gangs,’ said Special Agent Reynaldo Tariche, who investigated the case with other members of the FBI’s Long Island Gang Task Force.

Authorities say Garcia had a romantic relationship with Argueta, but she had ties to rival gangs.

Last October, the Treasury Department designated MS-13, or Mara Salvatrucha, as an international criminal organization.

Christie’s Broken Record

So far, the political discussion revolving around Chris Christie’s diminishing prospects for 2016 have centered on the George Washington Bridge scandal, (and the laughable investigation by his own attorney), and the not-yet-vetted story about Sandy aid being withheld from less-than-enthusiastic supporters of the governor. These are certainly key issues that tell us a great deal about Christie’s style and demeanor, but even without them, he simply doesn’t have a record that would support a national run.

There’s no New Jersey Miracle, no New Jersey Rebound, and no New Jersey Bounce (OK, there’s one of those, but it’s unrelated to economics and politics). The governor hasn’t led New Jersey into a new ideological paradigm, nor has he provided a new framework by which the state operates. Democrats still outnumber Republicans. His 2013 coattails were, shall we say, a bit short when it came to counting legislative seats. His Supreme Court nominees have been rebuffed.

And this guy wants to be president?

About all he can run on is a state worker’s pension and benefits bill that is providing little relief to anyone. Middle class public workers are being whacked because more money is coming out of their checks for pensions and health insurance (which should have been negotiated, not imposed), and property taxes remain stubbornly high (remember that these taxes were supposed to go down as a result of the pensions bill). The result is that the governor took spendable money out of the economy at a time when he should have been putting more money into the economy to create jobs. What we have in  New Jersey now is slow growth, a deteriorating middle class and a governor who wants to have public workers pay even more into their pensions. What about millionaires, you ask? He won’t touch their taxes.

Funny side note: Christie is seen as a moderate Republican. You can stop laughing now.

Christie’s latest economic gambit is to renege on his mandated duty to make full payments to the public worker pension system. That would put it in serious jeopardy and would negate a promise that the courts have ruled to be essentially non-negotiable. He’ll lose this argument and more credibility because the Democrats in the legislature will not cave in to him as they did in 2011 and the crossover vote that earned him his victory in November is abandoning him. Conservative Republicans in NJ still back him, but that’s not nearly a majority of the voters.

My sense is that the governor will survive the scandals. The larger question is whether New Jersey can survive him.
