Rape Suspect Jailed for 3 Months Begged for DNA Test

An Oklahoma man who was arrested and jailed for allegedly raping a 4-year-old girl intends to sue authorities for holding for three months while he pleaded with them to perform a DNA test, which eventually cleared him.

Tommy Braden, 26, of Sapulpa, Okla., was arrested in April 2012 after he called 911 in the morning to report that he had woken up to find his girlfriend’s daughter, age 4, bleeding on her bed. He also reported a broken window in their mobile home and blood on the front porch, Smolen told ABC News. Braden shared the home with his girlfriend, their biological child, and the 4-year-old.

According to Braden’s attorney Don Smolen, Creek County Sheriff’s officers arrested and charged Braden with the girl’s rape. Officials took a swab of his DNA at the time, but refused to test the sample for a DNA match with the semen and pubic hair found at the scene of the crime.

“He was openly cooperating, doing everything he can to prove that it wasn’t him,” Smolen said. “They found pubic hair and semen at the scene that’s never tested… It takes three months for them to get it done and only after the court orders them to do it… It’s just crazy to me.”

“Rarely do you have someone suspected of such horrific crime begging to give DNA. If you’ve got the opportunity where someone’s voluntarily giving you sample, why not get it tested and confirm or deny whether it was him?” the lawyer asked.

The Creek County Sheriff’s office did not respond to requests for comment from ABC.

Between The Rock and A Hard Place

Call it “fake”, call it whatever you’d like; I use to love to watch wrestling and have known Dwayne Johnson before he hit the silver screen as one of the all time greats, “The Rock”. From the start of the World Wrestling Federation (WWF) in 1996 to the Attitude Era in the late 90’s and early 2000’s, Dwayne “The Rock” Johnson was a wrestling superstar. Every time he’d enter and make his way to the ring the crowds would be cheering and going crazy. Throughout his Wrestling career he’d gain such nicknames as “The People’s Champion” , rack up 17 championship reigns, and win the 2000 Royal Rumble. Sadly though The Rock would take a prolonged hiatus from wrestling in 2004 to break onto the big screen.

Dwayne Johnson’s first major role

Dwayne Johnson’s first major role came as the Scorpion King in 2002; continuing on from his initial success from there he had a lead role in The Game Plan (2007), a part in Get Smart (2008),  the lead in The Tooth Fairy (2010), a part in The Race To Witch Mountain (2009), a role in Journey 2: The Mysterious Island (2012), Snitch (2013), and G.I Joe: Retaliation (2013). Probably Johnson’s most popular role has been his appearance in the famed Fast and Furious film series, as he appeared in Fast Five and has been confirmed for Fast and Furious 7. Off the silver screen, he has also had plenty of success on television judging by his numerous appearances on shows from Cory in the House to his newest reality/game show on TNT, The Hero. To say he’s been successful in pursing acting is a drastic understatement. Yet, Dwayne returned to where he started…wrestling.

“If ya smell…What The Rock, is cooking!”

The Rock made his long-awaited return to wrestling as the host of WrestleMania XXVII, appearing on the show Raw for the first time in seven years. From that one return The Rock would soon return to the ring and headline WrestleMaina XXVIII and the following one as well. Adding to his much hyped return from his long absence, The Rock won the WWE Championship and would reign for 70 days until he lost it again. This past April 7th, The Rock wrestled what may have been his last match, as he as yet to return to the ring citing an injury he suffered from WrestleMania. While I do love seeing him perform on the silver screen and on my TV, perhaps it is best now that The Rock retires for good from wrestling. There is no need to risk any further injury as he legacy has been engraved in stone.

I’d just like to say now though; Thank you Dwayne Johnson for entertaining me when I went to the movies. Lastly, Thank you The Rock for entertaining me and the wrestling world and for more importantly living up to your nickname, “The Most Eletrifiying Man in All of Entertainment.

How to Simply Meal Making and Eat Healthier

As a food writer and home cook, I love to cook.  But that doesn’t mean I want to spend every night in front of a cookbook and hot stove working on a recipe from Julia Child.

So I took an idea of Tim Ferris’s (author of The Four Hour Workweek):  simplify meals and diet by eating very similar things over and over- and ran with it.

He did it with weight loss and muscle gain as a goal.  I’m doing as a way to get back more time.

As a result, I spend less time thinking about what to make, move faster through farmer’s markets and the grocery store and spend less time preparing food.  Plus, I still enjoy what I eat as much as when I labored over what to make.

As an added bonus, I eat healthier because I’m not running for takeout because “there’s nothing at home to eat.”

You can do this too.  It takes a bit of organization and planning.  One day may be spent in more prep work (like today as I focus on a Cinco de Mayo theme) but most days of the week turn like clockwork.

If you feel overwhelmed by meal preparation, bothered by how much money is spent on take-out meals or simply want to eat healthier food, try this out and see if you can make it work for you.

  1. Figure out what you like to eat.
  2. Focus your meals around it every single week.
  3. Shop only for these foods.
  4. Switch it up every 6 weeks or so.

If this method seems like it might get boring, it’s not..

First the premise is that you eat things you enjoy.  This doesn’t mean chowing down on pizza every night.

It means eating foods that are healthy and likable.

If you are part of a large family, adding rituals around meal preparation can work very well at keeping budgets and diets in check.

Make a large pot of spaghetti sauce on Monday for Spaghetti Monday.  Use half the sauce and buy frozen raviolis for a Italian Wednesday.  Tuesday can be a Simple Chicken and Vegetable Stir fry with rice.  Thursday is soup and salad night.  Friday is homemade pizza night.  And so on and so forth.

This is how my week is looking:  I love salads.  I could eat a salad every day.  So I do.

I buy very similar ingredients (it sometimes varies depending what is the freshest looking at the farmer’s market.

Since it is Cinco de Mayo tomorrow there is a big pot of my Great-Grandma’s pinto beans simmering.  I’ll add chicken and Spanish rice to the menu for tomorrow night and eat the leftovers for the rest of the week.

Breakfasts will consist of alternating between cold cereal, cottage cheese and fruit or eggs.

Lunch will be baby carrots, almonds, a slice of hearty bread I made (banana bread this week).

I’ll have a salad most days, alternating with the leftover Mexican food.  If I want I can use the chicken, beans and chips to make a taco salad.

Oh, and I’m testing recipes for a cookie book so there is a solution for desserts and what to bring to social events.  🙂

If grocery shopping and meal preparation is exhausting, the bill for food keeps getting higher or you want to cut back on eating take-out food, try following your own designated menu for a few weeks.

As Thoreau said, “Our life if frittered away by detail, simplify! Simplify!”

Enough frittering with details about meals, shopping and preparation.  Get on with the important things:  enjoying a meal with your family, working on a startup, taking a walk; there are many excellent things to pursue.

The Cost of Guantanamo: $903,000 a Year per Prisoner

If Republicans want to reduce the budget, then closing Guantanamo would be the perfect place to start. But they’re still fighting President Obama’s efforts to close the prison.

The Pentagon estimates it spends about $150 million each year to operate the prison and military court system at the U.S. Naval Base in Cuba, which was set up 11 years ago to house foreign terrorism suspects. With 166 inmates currently in custody, that amounts to an annual cost of $903,614 per prisoner.

By comparison, super-maximum security prisons in the United States spend about $60,000 to $70,000 at most to house their inmates, analysts say. And the average cost across all federal prisons is about $30,000, they say.

The high cost was just one reason Obama cited when he returned this week to an unfulfilled promise to close the prison and said he would try again. Obama also said that the prison, set up under his Republican predecessor George W. Bush and long the target of criticism by rights groups and foreign governments, is a stain on the reputation of the United States.

Programs like Head Start and Meals on Wheels are being slashed because Republicans refused to end the self imposed Sequester, while we are flushing money down the drain in Guantanamo.

It would seem that closing the prison would be the smart and ideal thing to do, but doing so would fulfill one of Obama’s campaign promises, and that is simply not acceptable to the “deficit Hawks” in the Republican party.

So we continue. Wasting millions in Cuba, while precious services that protect children and poor people here in America, get slashed.

Funeral Director Says Cemeteries Don’t Want Boston Bomber’s Body

(AP) – A funeral home director was scrambling to find a cemetery that would bury a suspect in the Boston Marathon bombings, ignoring protesters gathered outside his business and saying everybody deserves a dignified burial service no matter the circumstances of his or her death.

Tamerlan Tsarnaev, 26, died from “gunshot wounds of torso and extremities” and blunt trauma to his head and torso, said Worcester funeral home owner Peter Stefan, who has Tsarnaev’s body and on Friday read details from his death certificate. The certificate lists the time of his death as 1:35 a.m. on April 19, four days after the deadly bombing, Stefan said.

Tsarnaev died after a gunfight with authorities who had launched a massive manhunt for him and his brother, ethnic Chechens from Russia who came to the United States about a decade ago. Police have said he ran out of ammunition before his younger brother dragged his body under a vehicle while fleeing.

Tsarnaev’s family was making arrangements Friday for his funeral as investigators searched the woods near a college attended by 19-year-old Dzhokhar Tsarnaev, who was captured less than a day after his brother’s death.

Heck Of A Run Boston – Knicks Move On To Indiana

It was not a pretty game for Knick fans, and it definitely was not a pretty game for Boston fans. The Knicks played game 6 in Boston after blowing game 5 in New York, and started the game as if on a mission. The scored quickly, going up 21 points to Boston’s 5 before Boston went on a small run and ended the quarter scoring 10 points total. Knicks had 24 after one.

In the second quarter, Boston was a little better. They watch the Knicks increase their lead to 18 points, but somehow managed to fight back with much of the help coming from Green, Terry and Garnett. Jason Terry, one of the Boston catalyst in game 5 scored a huge three pointer, cutting the 18 point lead by the Knicks. At the end of the second, Boston was within 13 with the score 39 Knicks, 27 Boston.

The third quarter the Knicks returned to the way they played in the early minutes of the first quarter. Carmelo Anthony up to this point had a quiet game, so it was up to his teammates to carry the load. And carry the load they did. A Huge game by Pablo Prigioni and threes by J. Smith, Shumpert and Felton contributed to the Knicks ending the quarter with their largest lead of the game, up by 20 points after the third.

After three quarters, the Knicks led 67, Boston 47.

By the start of the fourth quarter, the feeling in the auditorium was that the Knicks was getting ready to advance to the second round of the playoffs. Their first basket extended the lead to 22 points which caused Boston to pull Paul Pierce from the game. When the lead increased by 24 points with a basket by Smith, Pierce came back into the game and missed his first shot from behind the three point arch.

Another basket by the Knicks and it was a 26 point lead. Then Boston realized that their season was about to come to an end and started playing with reckless abandonment. This kid named Green scored a few points cutting the lead to 19. A few steals and baskets later, Boston was within 11 points and 19,000 fans were screaming “Defense! Defense!”

The scoring kept coming down and once again, the Refs made their presence known. Whistles were blown and the Boston fans applauded in agreement each time a Knick was called for the foul. Boston goes to the line and kept chipping away at the score. Before you knew it, Boston was within 7 with a 20-0 run.

The score with 5:44 remaining in the game was Knicks 75, Boston 69.

Whistles kept blowing and Green went to the line with 4 minutes remaining to score more points for Boston. 75 Knicks, 73 Boston.

Carmelo got fouled on the next position and made two from the line. Knicks 79, Boston 73. Boston then scored off a steal, but on the next position Carmelo made a jumper. Knicks 81, Boston 75 with 2:54 remaining to play. What could be the biggest play of the night came when Carmelo hit an open three pointer with 1:31 remaining, extending the Knicks lead back to 9 points.

Then J. Smith went to the basket for a layup on the next Knick possession and got fouled while making the basket. The lead extended back to double figures and that was all she wrote as Green walked off the court committing his 6th foul. The score with 1:21 remaining in the game was Knicks 87, Boston 78.

The final score in the end was Knicks 88, Celtics 80. And for the first time in 13 years, the New York Knicks advanced to the second round of the playoffs.

Knicks ended up shooting 42% on 33/79 shooting. They had 9 three pointers and 42 rebounds. Boston had 38%, shooting on 24 of 63 shots. They had 6 three pointers and 35 rebounds.

As he exited the game, the 18 year Basketball veteran, Boston’s Kevin Garnett hugged his coaching staff. The next game for New York would be in New York against Indiana.

Woman Left Unable to Walk, Talk after Surgeons Operate on Wrong Side of Brain

FENTON, Mo. (KSDK) – It was a botched brain surgery with massive consequences. A St. Ann woman went in for surgery on the left side of her brain, but the procedure was mistakenly performed on the right, and now the hospital is facing a lawsuit.

Pictures show proof. Fifty-three-year-old Regina Turner is seen in a photo with an indelible marking on the left side of her head. It was taken just before her April 4 surgery to put an end to a series of mini-strokes she’d been suffering from for several years.

Another photo shows Turner bandaged up on the right side after what’s called a craniotomy bypass.

“I think everybody in the operating room screwed up. I think somehow her head was marked for the correct side,” said Turner’s Clayton-based attorney Alvin Wolff. “The incorrect side was prepped for surgery. A whole surgery was performed, and nobody noticed that the side was wrong.”

Friday he filed a medical malpractice lawsuit against SSM Health Care St. Louis and neurosurgeon Dr. Armond Levy. He said negligence and carelessness led to the wrong-side surgery performed at St. Clare Health Center in Fenton.

According to the Journal of Neurosurgery, Wolff pointed out, there have been 35 documented cases of wrong-side craniotomies ever in the U.S.

“Sometimes the x-rays can be flipped,” he explained. “Sometimes the doctor doesn’t look at the medical records. Sometimes the surgery comes off late and everybody’s in a rush. Sometimes, if a doctor has a whole lot of surgeries, let’s say he’s got eight knees to do that day, and he’s got four right knees and four left knees, and the first knee cancels and they start moving everybody up, the wrong knee goes in the wrong room.”

Turner, who was mobile before, is now wheelchair bound. Her speech is unintelligible.

Kobe Bryant Takes Mom to Court

Kobe Bryant, the Los Angeles Lakers shooting guard, is embroiled in a legal spat with his mother and an auction house in New Jersey that is selling over 100 items from his early basketball career.

Goldin Auctions LLC, which is holding an auction on an unspecified date in June of items from Bryant’s childhood in Italy, his high school years in Pennsylvania and his early years in the NBA, filed a lawsuit against him on Thursday.

“The Bryant Collection,” which was consigned by the sports star’s mother, Pamela Bryant, includes trophies, championship rings, medals, plaques, game worn uniforms and other items.

Pamela Bryant, 59, made a deal in January with the auction house, receiving $450,000, which she used for a new home in Nevada. Five years ago, she had asked her son what he wanted to do with the items, but he had no interest in them, the Associated Press reported.

“Pamela Bryant also indicated that her son gave these items to her stating ‘here mom, these are for you’,” the complaint states.

So she had placed the items in a storage unit in New Jersey for $1,500 a month, the AP reported.

The centerpiece of the collection is Bryant’s Lower Merion High School basketball uniform with the number 24, which he wore as a freshman before he switched to number 33 for the remainder of his high school career, according to a press release.

“It is believed to be the only authentic game worn #24 Kobe Bryant LMHS jersey in existence. The next time he wore a #24 jersey was when he switched his NBA number to it after the 2005-06 NBA season,” the Goldin Auctions press release states. “When he finally removes #24 from his back, it will hang in the rafters alongside, Wilt, Kareem, Magic and Shaq.”

Ken Goldin, founder of Goldin Auctions, which sold a rare Honus Wagner baseball card last month for a record $2.1 million, declined to comment.

Mountain Dew to Release Lil Wayne Over Emmett Till lyric

A source tells theGrio PepsiCo is ending its association with rapper Lil’ Wayne, an endorser of the soft drink Mountain Dew.

Dissolving the partnership is a direct response to Wayne’s song lyric which referenced Emmett Till, the 14-year-old who was murdered in Mississippi in 1955 after being accused of whistling at a white woman.

Wayne apologized for the lyric after members of Till’s family objected, but his semi-apology was not accepted.

Now, the song has cost him his endorsement deal.

A Mountain Dew spokesperson told theGrio “We do not plan any additional work with Lil Wayne moving forward.  His offensive reference to a revered civil rights icon does not reflect the values of our brand.”

Mountain Dew was already under fire for a web video produced by rapper and leader of the Odd Future collective Tyler the Creator, which featured a goat participating in a criminal lineup as a physically abused white woman is terrified by subliminal threats not to identify him.

Here’s Something New: Republicans Will Try To Repeal ObamaCare #NoJoke

This one cannot be filed under the Breaking News category: House Majority Leader, Eric Cantor is promising his House Republicans that they would soon get a chance to vote to repeal ObamaCare.

“While we have not locked in the timing, I expect that the House will vote on full repeal of ObamaCare in the near future,” he told members.

Many Republicans have been eager to vote against the 2010 healthcare law, as they did last year. But so far, GOP leaders have refrained from calling up a repeal bill and instead tried to pass a tweak that failed to win enough GOP votes in April.

No, you did not stumble upon an old news article, this one was filed today, May 3rd, 2013. This new effort by Eric Cantor and his Republican party to take away health insurance from Americans would be their 40-something attempt at repeal.

Just another example of taxpayers dollars, paying these 435 House members to waste more time doing nothing.

Reese Witherspoon’s Arrest Video Goes Viral – Video

On April 21st, Reese Witherspoon became famous all over again when she asked a cop if he knew who she was. She was quickly arrested and tossed in the back of the cop’s patrol car.

Well now, video tape of the whole exchange has made it’s way around the internet, adding a whole new level of fame to Mrs. Witherspoon. A level we’re sure she would rather do without.

Witherspoon and her husband Jim Toth were pulled over in Atlanta after their car was observed weaving in traffic. Her husband was placed in handcuffs and at this point, Reese decided to make her presence known.

“I’m a U.S. citizen … I’m allowed to stand on American ground and ask any question I want to ask,” the Oscar winner said. But the officer was not having any of it and is seen placing Mrs Witherspoon in handcuffs. As he lead her off to sit in his car, Reese is heard asking the officer if he knew who she was. When the officer answered that he didn’t care to know, Reese replied,”you’re about to find out who I am.”

The Hollywood Reporter reports that Witherspoon was ordered to pay a fine of $215, and her husband must complete 40 hours of community service. He was also placed on 12 months of probation.

Rat meat sold as lamb in latest China food scandal

BEIJING (AP) — Chinese police have broken up a criminal ring accused of taking meat from rats and foxes and selling it as lamb in the country’s latest food safety scandal.

The Ministry of Public Security released results of a three-month crackdown on food safety violators, saying in a statement that authorities investigated more than 380 cases and arrested 904 suspects.

Among those arrested were 63 people who allegedly ran an operation in Shanghai and the coastal city of Wuxi that bought fox, mink, rat and other meat that had not been tested for quality and safety, processed it with additives like gelatin and passed it off as lamb.

The meat was sold to farmers’ markets in Jiangsu province and Shanghai, it said.

Despite years of food scandals — from milk contaminated with an industrial chemical to the use of industrial dyes in eggs — China has been unable to clean up its food supply chain.

The announcement came as China’s top court on Friday issued guidelines calling for harsher punishment for making and selling unsafe food products in the latest response to tainted food scandals that have angered the public.
