Investigation – NYPD Used “Excessive Force” to “Arrest” Tennis Star James Blake

Buzzfeed is reporting that an independent investigation by the Civilian Complaint and Review Board found that the the New York Police Department officer who mistakenly arrested James Blake last month used excessive force during the takedown.

“I appreciate the efforts of the CCRB to advance this investigation,” Blake said in a statement.

The NYPD arrested Blake on Sep. 9, after a group of plainclothes officers mistook him for a suspect in a credit card fraud scheme. The violent arrest, in which an officer tackled the athlete without warning, was captured on video. It soon emerged neither Blake nor the suspect, both of whom are black, had any connection to the scheme.

“We have been made aware of the CCRB’s findings. The department’s internal review is still on-going,” the NYPD said in a statement.

Although Blake was not seriously injured, the incident unleashed a public relations crisis for the NYPD, which still struggles with allegations of racial profiling and excessive force. Both Mayor Bill de Blasio and Police Commissioner Bill Bratton issued rare public apologies to the athlete, who said he welcomed the apologies but insisted that the city take substantive steps to address the issues.

The CCRB’s finding opens the door for a departmental trial against Officer James Frascatore, who tackled Blake, and Detective Daniel Herzog, who was also involved in the arrest. The two officers will have an advocate who will contrast their side of the story with the CCRB’s finding. In the end, Commissioner Bratton will have the final say on whether the officers will be disciplined, and if so in what form.

James Blake Says Officer Who Tackled And Arrested Him Should Be Fired

In an interview with the New York Daily News, the retired Tennis star James Blake, said that the officer who tackled him while he was standing outside a hotel waiting for a ride to the U.S Open, does not deserve to “have the same title as officers who are doing good work.”

“I want him to know what he did was wrong, and that in my opinion he doesn’t deserve to ever have a badge and a gun again, because he doesn’t know how to handle that responsibility effectively. He doesn’t deserve to have the same title as officers who are doing good work and are really helping keep the rest of the city safe.”

Blake was an apparent victim of “mistaken identity” by the New York police officer. He was tackled to the ground and arrested, then released after his identity was known. Blake is promising to use his celebrity status to bring to light a common police tactic of assuming that everyone is guilty and must prove their innocence.

The Mayor of New York and the Police Commissioner have issued formal apologies to James Blake.

“I’m lucky to be in the position I’m in, but I also talked to a lot of people the last few days that have had similar situations happen to them. Those are the people that deserve to be apologized to.”

James Blake is considering a lawsuit if changes aren’t implemented by the NYPD. Meanwhile, the officer, James Frascatore, who is white by the way, has been placed on desk duty.

His crime? I don’t know, but if I were to guess, his crime was standing in front a hotel while waiting for a ride to the U.S Open. That is when James Blake was tackled, thrown to the ground and handcuffed by a plainclothes New York Police officer.

Yes, that’s the same James Blake I’m talking about. The former professional Tennis player who had a rather impressive record during his playing days with 10 singles titles and 7 doubles titles.

The incident is now apparently a case of mistaken identity. For his troubles, Blake suffered bruises on his leg and a cut on his elbow. He was later released after police realized they had wrestled and arrested the wrong man.
