No Legalized Profiling in Arizona. ‘Papers Please’ Law Blocked

Let’s chalk one up, although temporary, for the America that believe in laws and the legal process. Just moments ago, the lawsuit filed by the Federal Government denouncing parts of the new SB1070 legislation in Arizona also known as the new Immigration Law or the “Papers Please” law, was temporarily struck down by a judge hearing the case.

According to the Federal Government's argument, if Arizona were to carry out certain aspects of the new legislation where police officers had the authority to determine who was illegal as is required by the legislation, then that would obstruct Federal Law and cause problems for legal citizens. The judge in the case, Susan Bolton agrees with this argument, saying;

“Requiring police in Arizona to determine the immigration status of every person who is arrested burdens lawfully present aliens, because their liberty will be restricted while their status is checked. Given the large number of people who are technically arrested but never booked into jail or perhaps even taken to a police station, detention time for this category of arrestee will certainly be extended. Requiring these people to prove their immigration status to the satisfaction of state authorities will unnecessary burden them, including some United States citizens.” (continue reading...)

Electing a Black President awoke a Sleeping Dog — Racism

It has now come to the point where every Monday morning it seems, Arizona's governor Jan Brewer signs another bill into law and the common denominator with these bills is simply racism.

SB1070, better know as the Show-Us-Your-Papers law was signed by governor Brewer and is geared at cracking down on illegal immigrants in the state. The purpose of this new law,

  • ===> to make attrition through enforcement the public policy of all state and local government agencies in Arizona. The provisions of this act are intended to work together to discourage and deter the unlawful entry and presence of aliens and economic activity by persons unlawfully present in the United States.
However, in the process of deterring "the unlawful entry and presence of aliens and economic activity," the new law asks it's police department to determine who is an illegal alien. SB1070 includes language on trespassing, which will give police officers the authority to stop anyone they deem to be trespassers, and then ask for their papers.
The specific provision on tresspassing states that,
  • ===> A person is guilty of trespassing if the person is "present on any public or private land in the state, and if they're in violation of 8 United States Code section 1304(e) or 1306(a).

The police officers in Arizona can now stop people on the street, which can be considered "public trespassing" and ask for their papers. It's then obvious that the law instituted to control illegal aliens, must determine through racial profiling who these  illegal alien are.

SB1070 not only makes it possible, but necessary for racial profiling in Arizona.

But Jan Brewer didn't stop there. She has now signed another piece of legislation into law. This time, she's not only attacking those that fit the profile of an illegal as outlined in SB1070, Jan Brewer has just signed a bill making it illegal to teach ethnic classes in Arizona's public schools.

HB2210 was signed into law less than 20 days after Jan Brewer signed SB1070, and calls for an end to public schools teaching about ethnic groups. No more teachings about the history of the United States involving Blacks, Asians, Latinos or Indians and the contributions these groups have made to America.  Jan Brewer and the Arizona Republicans have decided that Arizona students don't need to know about other ethnic groups, only the contributions of their own kind, Whites.

So it leads you to wonder, what is causing these types of legislations to be signed into law. Jan Brewer states the lack of Federal immigration laws as a reason for the Show-Us-Your-Papers law. She claims that the drug dealings and murders committed in Arizona has lead to these drastic new laws. However, these problems have been around for decades.

Illegal Immigration has always been a problem in America, and border states like Arizona have always been especially hard hit. But never has a state decided that they were going to take the steps Republican Jan Brewer has taken to eliminate the illegal immigration problem. Something has changed, and it's not the democrat in the White House, there's been democratic presidents before. It's the black democrat in the White House.

There is a conscience effort on the part of Jan Brewer, the republicans in congress who have decided to be against every policy this president proposed and even some that they themselves wrote, to make sure that Americans are divided and scared of each other. Their mission is not just winning the next election, but polarizing Americans to the point where simply learning about each other's racial heritage is no longer possible. A divided nation is a failed nation, and nothing will divide a nation more than pointing out the racial boundary and insisting through laws that these boundaries be maintained.

The election of Barack Obama, the first black president of the United States, has not brought Americans together. We have not crossed the racial boundary that divided us. The election has given these republicans a reason to picked at the old scab that has plagued this country since slavery. What was supposed to be progress and the coming together of all races, the learning of our fellow American and the vision of a country moving forward as one people, has been intentionally turned into an us vs them mentality.

The black president in the White House must not succeed and they'll use the most divisive method available to make sure he fails. They will turn his presidency into Us vs. Them, Whites vs Minorities.

The sleeping dog called Racism is now a awake, thanks to those Republicans like Jan Brewer.

The Birther’s Aspect of Arizona’s Immigration Law

In their effort to rid Arizona of all illegals, the state legislatures has drafted a bill that not only legalize racial profiling, but has also pander to the birther's group. Either intentional or by mistake, the new Arizona law will require President Obama to show his Birth Certificate while in Arizona, or face the possibility of arrest and or deportation.

Ok now back to the article.

Yes, this bill as it's now constructed in Arizona, will allow the police officers to question anyone, including the President of the United States if or when the president is in Arizona.

Was this a just an unfortunate side effect, or was this the driving factor in the New Arizona bill SB1070?

On Section 2, Title 11, Chapter 7, Article 8, Line 37 reads;
  • A law enforcement officer, without a Warrant, may arrest a person if the officer has probable cause to believe that the person has committed any public offence that makes the person removable from the United States.
According to this bill, what constitutes "probable cause" could be an action as simple as public or private trespassing.
Section 3, Title 13, Chapter 15, Line 42 reads;
  • In addition to any violation of Federal Law, a person is guilty of trespassing if the person is both:
  1. Present on any public or private land in this state
  2. In violation of 8 United States Code Section 1304(e) or 1306(a). - This section of the Federal law states 
          Every alien, eighteen years of age and over, shall at all times
        carry with him and have in his personal possession any certificate
        of alien registration or alien registration receipt card issued to
        him pursuant to subsection (d) of this section. Any alien who fails
        to comply with the provisions of this subsection shall be guilty of
        a misdemeanor and shall upon conviction for each offense be fined
        not to exceed $100 or be imprisoned not more than thirty days, or
        both.

So then according to this new law, just being in Arizona on any public road and not having documents on you explaining your legal or illegal status, is grounds to be stopped and questioned by an officer.

Is there anything in this bill that's stopping you or me, or President Obama from being stopped and asked to present papers? No. Just being on the public road is grounds enough to be stopped. It is considered trespassing and gives the law enforcement officers the authority to stop and question you on your papers.

As it turns out, the Birthers believe that President Obama is not really president because as far as they're concerned, he was born in Kenya. So any visit by the president to Arizona will constitute the president trespassing, and thus, according to this new law, subject him to questions about his papers and arrest if they're not on his person.

The Birthers have finally find a way to deport President Obama back to the Kenya!
